TERMS AND CONDITIONS OF THE ONLINE SHOP
of Ginger & Fred s.r.o.
for the sale of vouchers through the online shop available at https://eshop.gfrest.cz.
1. Introductory Provisions
1.1. These Terms and Conditions (hereinafter referred to as the "Terms and Conditions") govern the mutual rights and obligations between:

(hereinafter referred to as the "Seller")
and a natural person who, outside the scope of their business activities or independent professional practice, enters into a contract with the Seller through the online shop (hereinafter referred to as the "Buyer" or "Consumer").
1.2. The online shop is operated at https://eshop.gfrest.cz (hereinafter referred to as the "Online Shop").
1.3. Through the Online Shop, the Seller offers, in particular, vouchers entitling their holders to use the services specified for each individual voucher (hereinafter referred to as the "Voucher").
1.4. These Terms and Conditions form an integral part of the contract concluded between the Seller and the Buyer through the Online Shop.
1.5. The contract and these Terms and Conditions are governed by Czech law. The Czech version of the Terms and Conditions shall prevail in the event of any discrepancy between language versions.
2. Voucher Offer and Validity
2.1. The Online Shop contains information about individual Vouchers, in particular a description of the service for which the Voucher may be used, the price of the Voucher, its validity period and any additional conditions of use.
2.2. The specific scope of the service that may be used on the basis of a Voucher is always specified in the description of the respective Voucher.
2.3. A Voucher may only be used during the validity period stated directly on the Voucher or in its description in the Online Shop.
2.4. Once the Voucher has expired, the right to redeem it shall cease unless otherwise agreed between the Seller and the Buyer.
2.5. Vouchers cannot be exchanged for cash.
2.6. Unless otherwise stated for a specific Voucher, each Voucher may only be used once.
2.7. If prior reservation is required to use a service, the Voucher holder is obliged to make the reservation in the manner specified in the respective offer or on the Voucher.
2.8. The purchase of a Voucher does not in itself guarantee the availability of a particular date or time for the provision of the service. The Voucher holder is therefore advised to make a reservation sufficiently in advance.
3. Order and Conclusion of the Contract
3.1. The Buyer places an order using the order form available in the Online Shop.
3.2. Before submitting the order, the Buyer has the opportunity to review and modify the information entered in the order and to correct any errors.
3.3. The Buyer submits the order by clicking a button clearly indicating that submitting the order entails an obligation to pay the purchase price.
3.4. By submitting the order, the Buyer confirms that they have read and agree to these Terms and Conditions.
3.5. The Buyer's order constitutes a binding proposal to conclude a contract.
3.6. The Seller shall confirm receipt of the order by sending an electronic message to the e-mail address provided by the Buyer in the order.
3.7. The contract is concluded when the Seller confirms the order, unless otherwise specified during the ordering process.
3.8. Before confirming the order, the Seller is entitled to contact the Buyer to verify the information provided or clarify the terms of the order.
4. Price and Payment Terms
4.1. The price of each Voucher is stated in the Online Shop next to the respective offer.
4.2. All prices are stated as final prices, including the applicable value added tax and all mandatory charges, unless expressly stated otherwise.
4.3. The Buyer may pay for the order using the payment methods currently available in the Online Shop.
4.4. The specific payment methods available to the Buyer are displayed before the order is completed.
4.5. In the case of cashless payment, the price shall be deemed paid when the relevant amount is credited to the Seller's account or when successful payment is confirmed by the payment service provider.
4.6. The Seller shall issue the Buyer with the relevant proof of payment in accordance with applicable legislation.
5. Delivery of the Voucher
5.1. As part of the order, the Buyer may choose one of the currently available forms of the Voucher:
a) electronic Voucher (e-voucher); or
b) printed Voucher for personal collection.
Electronic Voucher
5.2. Following successful completion of the order and payment of the purchase price, the electronic Voucher shall be sent to the e-mail address provided by the Buyer in the order.
5.3. The Buyer is responsible for providing a correct e-mail address when placing the order.
5.4. If the Buyer does not receive the electronic Voucher, the Buyer is advised to first check their spam or junk mail folder and subsequently contact the Seller.
Printed Voucher
5.5. If the Buyer chooses a printed Voucher, the Voucher shall be prepared for personal collection at:
Jiráskovo náměstí 1981/6, Prague 2, Czech Republic.
5.6. The Buyer may be notified that the Voucher is ready for collection using the contact details provided in the order.
5.7. The Seller does not deliver printed Vouchers by courier or postal service unless expressly stated otherwise in the respective offer.
6. Redemption of the Voucher
6.1. The Voucher entitles its holder to use the service specified on the Voucher or in the description of the respective offer.
6.2. When redeeming the Voucher, the holder may be required to present the Voucher or provide its unique code.
6.3. The Buyer is responsible for protecting the Voucher and its unique code against access or use by unauthorised persons.
6.4. The Seller shall not be liable for the misuse of a Voucher by a third party if such misuse occurred as a result of the Buyer or Voucher holder making the Voucher or its code available to a third party.
6.5. The Voucher may only be redeemed within the scope, under the conditions and during the validity period specified for the respective Voucher.
6.6. If a Voucher is issued for a specific service, it may only be used for that service unless otherwise agreed with the Seller.
7. Right of Withdrawal
7.1. A Buyer who is a Consumer has the right, in accordance with the Czech Civil Code, to withdraw from a contract concluded online without giving any reason within 14 days from the conclusion of the contract, unless otherwise provided by law.
7.2. The withdrawal period shall be deemed observed if the Buyer sends the notice of withdrawal to the Seller no later than on the final day of the withdrawal period.
7.3. The Buyer may send the notice of withdrawal electronically to the Seller's e-mail address info@gfrest.cz or in writing to the Seller's registered office.
7.4. The Buyer may use the model withdrawal form provided at the end of these Terms and Conditions. The use of this form is not mandatory.
7.5. If the Voucher has already been redeemed before the expiry of the withdrawal period and the service has been fully provided at the Buyer's express request or with the Buyer's consent, the Buyer's right of withdrawal may cease under the conditions laid down by applicable law.
7.6. If the Buyer requests that the provision of a service commence before the expiry of the 14-day withdrawal period and subsequently withdraws from the contract before the service has been fully provided, the Buyer shall be required to pay the Seller a proportionate amount corresponding to the services already provided, provided that the statutory conditions for such payment have been met.
7.7. In the event of a valid withdrawal from the contract, the Seller shall refund all funds received from the Buyer without undue delay and no later than 14 days from the date on which the Seller was informed of the withdrawal.
7.8. The Seller shall refund the funds using the same payment method used by the Buyer for the original transaction, unless the parties agree otherwise and provided that the Buyer does not incur any additional costs as a result.
7.9. From the moment the withdrawal becomes effective, the Voucher may no longer be used. The Seller is entitled to deactivate the Voucher or its unique code.
8. Complaints and Rights Arising from Defective Performance
8.1. The Seller is responsible for ensuring that the Voucher and the service for which the Voucher may be redeemed comply with the contract and the information provided in the Online Shop.
8.2. The Buyer may submit a complaint in particular where:
- the electronic Voucher was not delivered due to circumstances attributable to the Seller;
- the Voucher contains incorrect information;
- the Voucher cannot be redeemed due to technical reasons attributable to the Seller;
- the Voucher's unique code does not function correctly;
- the service provided does not correspond to the agreed conditions or is otherwise defective.
8.3. Complaints may be submitted:
- electronically by e-mail to: info@gfrest.cz;
- in person at Jiráskovo náměstí 1981/6, Prague 2, Czech Republic;
- or in writing to the Seller's registered office.
8.4. The Buyer should include in the complaint, in particular, their contact details, order or Voucher number, a description of the defect and the requested method of resolving the complaint.
8.5. The Seller shall provide the Buyer with confirmation of the complaint containing the information required by law.
8.6. The Seller shall assess and process the complaint without undue delay. A Consumer's complaint, including the remedy of the defect, shall be resolved no later than 30 days from the date on which the complaint was submitted, unless the Seller and the Buyer agree on a longer period.
8.7. The Buyer shall be informed of the outcome of the complaint using the contact details provided by the Buyer.
8.8. If the complaint is justified, the Buyer shall be entitled to the remedies provided for by applicable law, including, where the statutory conditions are met, rectification of the defect, replacement performance, an appropriate price reduction or withdrawal from the contract.
9. Cancellation or Modification of a Reserved Service
9.1. Where redemption of a Voucher requires the reservation of a specific date or time, the cancellation or modification of such reservation may be subject to the cancellation conditions applicable to the specific service or communicated to the Buyer when making the reservation.
9.2. If the Buyer or Voucher holder fails to use the reserved service or fails to cancel the reservation in accordance with the applicable cancellation conditions, the Voucher may be considered redeemed, provided that the Buyer was informed of this condition in advance.
9.3. If the Seller is unable to provide the service on the reserved date or time, the Seller shall offer the Buyer or Voucher holder an alternative date or another appropriate solution.
10. Personal Data Protection
10.1. The Seller processes the Buyer's personal data in accordance with applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
10.2. Detailed information regarding the processing of personal data is provided in the separate Privacy Policy available on the Seller's website.
11. Alternative Dispute Resolution
11.1. In the event of a consumer dispute arising between the Seller and the Buyer, the Buyer has the right to seek alternative dispute resolution.
11.2. The competent authority for alternative dispute resolution of consumer disputes is:

11.3. The Buyer may contact the Czech Trade Inspection Authority under the conditions laid down by applicable legislation.
12. Final Provisions
12.1. Legal relationships between the Seller and the Buyer shall be governed by the laws of the Czech Republic, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection, as amended.
12.2. The choice of Czech law shall not deprive the Consumer of any protection afforded by mandatory provisions of applicable law from which the parties cannot derogate by agreement.
12.3. If any provision of these Terms and Conditions becomes invalid or ineffective, this shall not affect the validity or effectiveness of the remaining provisions.
12.4. The Seller is entitled to reasonably amend or supplement these Terms and Conditions. Each individual order shall be governed by the version of the Terms and Conditions effective at the time the contract was concluded.
12.5. These Terms and Conditions shall become effective on 31.08.2026.
